Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Disclaimer:
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Disclaimer) refers to Batalyse GmbH, Sattlerstrasse 5, 75045 Walzbachtal.
- Service refers to the Application.
- You/Your means the individual accessing the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
- Application means the software program provided by the Company downloaded by You on any electronic device or accessed by your browser named Data Analysis, Collect or Mind.
- Test Data means any files, graphs, measurements, drawings or information that can or should be evaluated or processed by the Application or which are or should be the result of the Application.
- Data Analysis is a Batalyse software module to evaluate/benchmark electrochemical test data. It is installed as an app for the software Origin on a local computer of Yours.
- Collect is a Batalyse software module to manage test data. It can be tested on the Batalyse online demo server. Collect is installed on your local hardware.
- Mind is the Batalyse software for “Lab Information and Management”. It can be tested on the Batalyse online demo server. Mind is installed on your local hardware.
- A Demo Server is hosted by Batalyse to provide You with a testing option of the software without installing it locally on your hardware and to show you new features in advance. Administration features are either limited or excluded to You.
- The License for the Application can be provided online or offline. An online license requries an internet connection to run the Application. An offline license doesn’t require an internet connection and no Test Data, no Usage Data and no information are shared with Us or third parties.

The information contained on the Service is for general information purposes only.
The Company assumes no responsibility for errors or omissions in the contents of the Service.
In no event shall the Company be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice. The Company does not warrant that the Service is free of viruses or other harmful components.

User and Usage Data- Disclaimer
- We do not forward or share User and Usage Data with any other party.
- If the provided License type is online the Application tracks its usage statistics, e.g. number of launches, number of evaluations and bug events, and shares this information with Us.
Data Analysis, Collect/Mind (online Demo Server)
You are required to provide a valid email address. For the creation of the license, information about You and/or Your computer and/or Your Origin license will be automatically transferred to Us. The license will then be connected to Your server/computer, the Origin license number, a limited number of usages or a combination of said options.
Your email address will be used to contact You in the event of new software versions, new products or features, bugs or to mail you the Batalyse newsletter. You can opt-out any time you want.
“Test and Measurement Data” Disclaimer
- The Application does not collect Your Test Data and We have no access to it. To fix bugs or implement desired features, it may be necessary for You to voluntarily provide us with Test Data by email, our file server or any other transfer method.
- If You use the Mind and Collect online Demo Server you can upload own Test data voluntarily which can be seen and accessed by Us.
We do not forward or share your Test Data with any other party.
